Read this before your child plays. BrightDots Game Center is designed for children aged approximately 4 to 9. It uses a microphone and an AI voice assistant powered by OpenAI. A parent or legal guardian must read and accept these Terms and give permission before a child uses it. If you do not agree, do not allow your child to use the games.

1. Who may accept these Terms

You must be at least 18 years old and the parent or legal guardian of the child who will play. By entering a beta invitation code, or by allowing a child to use BrightDots Game Center, you confirm that you are that parent or guardian and that you accept these Terms on your own behalf and on behalf of your child.

Children may not accept these Terms themselves.

2. Parental permission and consent

2.1 What you are consenting to

By giving permission you consent to all of the following:

2.2 Voice mode is optional

Both games are fully playable, and winnable, without voice. If you do not wish your child's speech to be sent to OpenAI, simply do not start voice mode. Touch and keyboard controls give access to every feature.

2.3 Choose a display name that is not personal

The games ask your child for a name to display and to label leaderboard scores. We recommend a first name only, a nickname, or an invented name. Please do not enter a full legal name, school, address, or any other identifying detail. The name your child enters is included in the context sent to OpenAI so the assistant can greet them by name.

2.4 Withdrawing permission

You may withdraw permission at any time by ceasing use and clearing the site's stored data in your browser. Instructions are in the System Help document. Withdrawal does not require you to contact us, though you may write to drew@centerbeam.ai with any request.

Parental Permission — acknowledgement

By ticking below, or by entering a beta invitation code, I confirm that:

  1. I am at least 18 and the parent or legal guardian of the child who will play.
  2. I have read and accept these Terms of Use and the Privacy Policy.
  3. I give permission for the microphone use and for speech to be processed by OpenAI as described in Sections 2.1 and 4.3.
  4. I understand the assistant is an AI and can be wrong (Section 5).
  5. I will supervise my child's use as appropriate to their age.

3. Private beta

BrightDots Game Center is currently a private beta. Access requires an invitation code issued by us. You agree:

  1. Not to share your invitation code outside your household.
  2. That access is personal, revocable, and may expire without notice.
  3. That beta software may contain defects, may change substantially, and may become unavailable at any time.
  4. That we may end the beta, or your access to it, for any reason.
  5. Not to publicly disclose screenshots, recordings, or details of unreleased features without our written permission.

4. What we collect, and what we do not

4.1 We collect no child personal information, with adult participation and parent-approved submissions for minors.

We do not ask for, and do not store, any personally identifying information about your child. There are no accounts. We do not collect names, email addresses, postal addresses, telephone numbers, dates of birth, photographs, location, or payment details. There is nothing to sign up for and nothing to sign in to.

The invitation code you were given identifies a wave of invitations, not a person. We cannot tell from it who you are.

4.2 Anonymous usage data we may collect

To find bugs and improve the games, we may collect the following in a form not linked to you or your child, and not linked to each other across sessions:

This tells us that a player struggled at a certain point, or that a page was visited. It does not tell us which player, and we make no attempt to re-identify anyone from it.

Google Analytics. Our informational pages — this page, the Privacy Policy, the beta feedback form, and the game help pages — use Google Analytics to count anonymous page views. The Game Center hub and the games themselves (Clara's Kitchen, Will's Gone Fishin') do not use Google Analytics or any other analytics tool. Nothing about how your child plays is tracked. Where it is used, it is configured to the most restrictive setting Google offers: no advertising cookies, no cross-device or demographic profiling ("Google Signals"), no ad personalization, and IP addresses are anonymized. Google Analytics does not receive your child's display name, scores, or anything typed or said in the games — that data flows only to OpenAI as described in Section 4.3.

4.3 OpenAI processes the voice conversation

The voice assistants — Clara and Will — are powered by OpenAI. When voice mode is running, the following is sent to OpenAI so the assistant can hear your child and reply:

OpenAI is an independent company and its handling of this data is governed by its own terms and privacy policy, not by ours. Please review them: OpenAI Privacy Policy. We do not control, and make no representation about, how long OpenAI retains data or how it is used on their systems.

If you are not comfortable with this, do not start voice mode. No audio is captured or transmitted at any other time, and the games remain fully playable by touch and keyboard.

This is also why we ask you, in Section 2.3, to choose a nickname rather than a real name: whatever display name is entered travels with the game context, and we would rather it carried no personal meaning.

4.4 What stays on your device

Stays on your device The display name your child enters, game scores and the local leaderboard, and accessibility preferences such as slow-speech mode. These live in your browser's local storage. We never receive them.
Leaves your device While voice mode is active only: the audio, transcript and game context in Section 4.3, sent to OpenAI. Plus the anonymous chat history and interaction events in Section 4.2. Anonymous page views (Google Analytics) are sent only when one of our informational pages loads — Privacy Policy, Terms of Use, beta feedback form, or a help page — never from the Game Center hub or the games themselves.
We never collect Names, email addresses, postal addresses, telephone numbers, dates of birth, photographs, location, or payment details.

We do not sell information of any kind, and we do not show advertising in these games.

Children's privacy. These games are directed to children under 13. Our approach for this beta is to collect with adult participation and parent-approved submissions for minors. from anyone, so there is nothing about your child for us to hold, disclose, or lose. If you believe we have nonetheless received something we should not have, contact drew@centerbeam.ai and we will delete what is within our control. Data held by OpenAI must be pursued through OpenAI.

5. The AI assistant can make mistakes

Clara and Will are AI characters built on OpenAI models. They can misunderstand speech, say something inaccurate, or respond unexpectedly. They are entertainment and gameplay guides only.

They are not a tutor, a therapist, a medical or educational adviser, or a substitute for adult supervision. Do not rely on anything they say as fact, advice, or instruction. Speech recognition may work less well for children with speech differences, and no guarantee of accuracy is given.

6. Acceptable use

You and your child agree not to:

  1. Attempt to bypass, disable, or interfere with the beta access gate or any other part of the service.
  2. Reverse engineer, decompile, copy, or redistribute the games or their content.
  3. Use the service to store or transmit unlawful, harmful, or abusive content.
  4. Use automated means to access the service, or place unreasonable load on it.
  5. Enter another person's personal information into any field.

Your use of the voice assistant is also subject to OpenAI's usage policies, which prohibit certain categories of content and behaviour.

7. Intellectual property

The games, characters, artwork, audio, text, and software are owned by Centerbeam AI, a dba of Cloud Media Works, LLC and its licensors, and are protected by copyright and other laws. Your invitation grants a limited, personal, non-transferable, revocable licence to use the games for private, non-commercial family use during the beta. No other rights are granted.

If you send us feedback, you agree we may use it without obligation or compensation.

8. Availability, and no warranty

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any defect will be corrected. Voice features depend on OpenAI and on your internet connection, and may be unavailable or degraded at any time.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law, Centerbeam AI, a dba of Cloud Media Works, LLC and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, arising out of or relating to your use of the service.

Our total aggregate liability relating to the service will not exceed USD $100.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

10. Health and safety

These games use sound, colour, and motion. If your child is sensitive to flashing or moving imagery, enable your device's "reduce motion" setting, which the games honour and which disables all animation. Encourage regular breaks and set device volume to a safe level before play.

11. Suspension and termination

We may suspend or terminate access at any time, with or without notice, including on expiry of an invitation, at the end of the beta, or if these Terms are breached. You may stop using the service at any time.

12. Changes to these Terms

We may update these Terms. If a change is material, we will update the effective date above and, where practical, notify you. Continued use after a change means you accept the revised Terms. If you do not accept them, stop using the service.

13. Governing law

These Terms are governed by the laws of California, USA, without regard to conflict of law rules. The courts of Santa Clara County, California will have exclusive jurisdiction, except where mandatory local consumer law provides otherwise.

15. Entire agreement

These Terms and the Privacy Policy are the entire agreement between you and us regarding the service. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it.
